Terms of Service
These Terms govern your use of A11yOps, an accessibility scanning and remediation service operated by Oleks Tech OÜ, Estonia (“A11yOps”, “we”, “us”). By creating an account, running a scan, buying a plan, or otherwise using the service, you agree to these Terms.
1. The service
A11yOps scans web pages for accessibility issues, prioritises them, and produces reports, scores, screenshots, developer-ready remediation tickets, and fix guidance. Some features are automated; some involve human review. We may add, remove, or change features as the product evolves.
2. Your account
You are responsible for your account and for keeping your credentials secure. You can sign in with an email and password or with Google. You must provide accurate information and be at least 16 years old. If you use A11yOps on behalf of a company or other organisation, you confirm that you are authorised to bind that organisation to these Terms.
3. Scanning — authorised use only
This matters. You may submit a URL to A11yOps only if you own the website or are otherwise authorised to test it. By submitting a URL you confirm you have that authorisation. A11yOps is designed for public web pages and does not intentionally submit forms, complete checkout/payment flows, or access private areas unless a separate written scope says otherwise. You must not use A11yOps to scan, probe, overload, scrape, attack, or burden websites you do not control or have permission to test, or to attempt to gain unauthorised access to any system.
You are responsible for the URLs and content you submit, including any personal data that appears on those pages. Do not submit sensitive, private, authenticated, or confidential pages unless you have the legal right to do so.
4. No legal compliance guarantee
A11yOps provides technical accessibility checks and remediation suggestions. It is not a legal compliance certification and not a substitute for a professional manual audit or legal advice. Automated and heuristic testing detects only part of accessibility issues, and a passing score does not guarantee compliance with WCAG, the European Accessibility Act, the ADA, or any other standard or law. You remain responsible for your own legal compliance.
5. Plans, billing, and trials
Paid plans are billed in advance through Stripe on a recurring basis until cancelled. Where we offer a free trial, you will not be charged until the trial ends — cancel before then to avoid a charge. You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period. Except where required by law or expressly stated in writing, fees are non-refundable.
Prices may exclude VAT, sales tax, withholding tax, or other applicable taxes unless stated otherwise. You are responsible for taxes that apply to your purchase. We may change published prices, but changes to recurring subscriptions apply from a future renewal after reasonable notice.
6. Remediation work
Fixed-fee remediation, pull requests, implementation help, or deeper human review may be scoped, quoted, and invoiced separately. Any separate written scope, proposal, statement of work, or invoice governs that specific work if it conflicts with these general Terms. Unless we agree otherwise in writing, remediation output is guidance and code suggestions for your team to review, test, and merge.
7. Your content and our platform
You keep all rights to the websites, code, URLs, content, and data you submit. You grant us the limited licence needed to provide and improve the service — for example, to fetch and analyse your pages, store reports, generate screenshots, prepare tickets, and provide fixes. We keep all rights to the A11yOps platform, software, workflows, and brand; these Terms do not transfer them to you.
8. Acceptable use
Do not misuse the service: no illegal use; no infringement of others' rights; no malware, spam, credential theft, scraping abuse, or security attacks; no attempts to break, overload, reverse-engineer, resell, or circumvent the service or its limits; and no use that violates section 3. We may throttle, suspend, or block activity that creates technical, legal, security, or reputational risk.
9. Third-party services
A11yOps depends on third-party services such as hosting providers, browser automation, payment processors, email providers, Google sign-in, and other infrastructure. We are not responsible for third-party services outside our control, but we choose providers that are appropriate for operating the service.
10. Privacy
Our Privacy Policy explains how we handle personal data. By using A11yOps, you also agree that we may process data as described there.
11. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free, or that it will detect every accessibility issue, produce every possible fix, or satisfy any specific legal or procurement requirement.
12. Limitation of liability
To the fullest extent permitted by law, Oleks Tech OÜ and A11yOps will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business interruption. Our total liability for any claim relating to the service is limited to the amount you paid us for the service giving rise to the claim in the 12 months before the event that created the claim. Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnity
You agree to indemnify A11yOps and Oleks Tech OÜ against claims arising from your misuse of the service, your breach of these Terms, your submitted content, or any claim that you were not authorised to scan, process, or submit a URL or page content.
14. Termination
You can stop using A11yOps and close your account at any time. We may suspend or terminate access if you breach these Terms or use the service in a way that creates risk or legal exposure for us or others. After termination, sections that by their nature should continue will continue, including payment obligations, intellectual property, disclaimers, liability limits, indemnity, and governing law.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of Estonia, without regard to conflict of law rules. The courts of Estonia have exclusive jurisdiction over disputes relating to these Terms or the service, unless mandatory law gives you the right to bring proceedings elsewhere. Nothing in these Terms limits rights that cannot be waived under mandatory consumer protection law.
16. Changes
We may update these Terms as the service changes. We will update the date above and, for material changes, give reasonable notice. Continuing to use A11yOps after changes take effect means you accept the updated Terms.
